This website is operated by Lorena Martin, trading as KINOA. Throughout the site, the terms "we", "us" and "our" refer to KINOA. KINOA offers this website (kinoawear.com), including all information, tools and services available from it, to you, the user, on condition that you accept all the terms, conditions, policies and notices stated here. 

By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to these Terms of Service ("Terms"), including the additional policies referenced here or available by hyperlink (Returns & Refund Policy, Shipping Policy, Privacy Policy and Cookie Policy). These Terms apply to all users of the site. 

Please read these Terms carefully before using the site. If you do not agree with them, you should not use the site or our services. We may update these Terms by posting changes on this page; changes will not apply to orders already placed. 

Our store is hosted on Shopify Inc., which provides the online e-commerce platform that allows us to sell our products to you. 

Section 1 – Online store terms 

By agreeing to these Terms, you confirm that you are at least 18 years of age, or that you have the consent of your parent or legal guardian to use this site. 

You may not use our products for any illegal or unauthorised purpose, nor may you, in using the Service, violate any laws in your jurisdiction. You must not transmit any viruses or code of a destructive nature. A breach of these Terms may result in the immediate termination of your access to the Service. 

Section 2 – General conditions 

We may refuse service to anyone for justified reasons (for example, suspected fraud or abuse). 

Your card information is always encrypted during transfer. You agree not to reproduce, duplicate, copy, sell, resell or exploit any part of the Service without our express written permission. The headings in these Terms are included for convenience only and do not limit or affect them. 

Section 3 – Accuracy and completeness of information 

We do our best to keep the information on this site accurate and up to date, but it may occasionally contain errors. Content on the site (for example, blog posts or workout tips) is for general information only. 

Section 4 – Changes to the Service and prices 

Prices for our products may change without notice. The price that applies is always the one shown when you confirm your order. We may modify or discontinue the Service (or any part of it) at any time. 

Section 5 – Products 

Some products may be available exclusively online and in limited quantities, and may only be returned or exchanged in line with our Returns & Refund Policy. 

Activewear. We have made every effort to display the colours, textures and finishes of our garments as accurately as possible, but we cannot guarantee that your device’s screen will display them exactly. Please check our Size Guide and the care instructions for each garment. 

Home workout equipment & accessories. Before using any equipment, read and follow its instructions, respect the stated weight and load limits, check its condition before each use and use it on a suitable surface. Keep it out of the reach of children. If you have an injury or medical condition, are pregnant, or are new to exercise, consult a health professional before starting. Incorrect use of equipment may cause injury. This does not limit our liability for defective products under the law. 

We reserve the right to limit the sale of our products to any person, region or jurisdiction, to limit the quantities of any product, and to discontinue any product at any time. 

Section 6 – Orders, billing and account information 

Your contract with us is formed when we send you the order confirmation email. We may refuse or cancel an order (for example, due to lack of stock, a pricing error or suspected fraud); if so, we will notify you by email and refund any amount charged. We may also limit or prohibit orders that appear to be placed by dealers, resellers or distributors. 

You agree to provide current, complete and accurate purchase and account information and to keep it up to date so that we can complete your orders and contact you. All prices are in euro (€) and include VAT. For more details, see our Returns & Refund Policy and Shipping Policy. 

Section 7 – Optional tools 

We may give you access to third-party tools that we do not monitor or control. Their use is optional and at your own risk, and you should review the terms on which they are offered by their providers. Any new features or tools added to the site will also be subject to these Terms. 

Section 8 – Third-party links 

Certain content, products and services available through the site may include materials from third parties or links to websites not affiliated with us. We are not responsible for the content or accuracy of those sites, nor for any harm related to transactions made on them. Complaints about third-party products should be directed to the third party. 

Section 9 – User comments, reviews and other submissions 

If you send us ideas, suggestions, reviews, photos or other materials (for example, through product reviews on the site or by tagging us on social media), you allow us to use, edit and publish them on our channels, crediting your name or username where appropriate. If you would prefer us not to, just let us know. 

We may remove content that we consider unlawful, offensive, threatening, defamatory or obscene, or that infringes third-party intellectual property or these Terms. You agree that your comments will not violate the rights of any third party, will not contain unlawful material or viruses, and that you will not impersonate anyone. You are responsible for the comments you post. 

Section 10 – Personal information 

Your submission of personal information through the store is governed by our Privacy Policy. 

Section 11 – Errors, inaccuracies and omissions 

Occasionally there may be typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, delivery times or availability. We reserve the right to correct them and, if an error affects an order you have already placed, we will contact you so you can choose whether to keep it or cancel it with a full refund. 

Section 12 – Prohibited uses 

In addition to the other restrictions in these Terms, you may not use the site or its content: (a) for any unlawful purpose; (b) to encourage others to carry out unlawful acts; (c) to breach any regulations or laws; (d) to infringe our intellectual property rights or those of others; (e) to harass, abuse, defame or discriminate; (f) to submit false or misleading information; (g) to upload viruses or malicious code; (h) to collect the personal data of other users; (i) to spam or phish; or (j) to interfere with the security of the Service. 

Section 13 – Warranties and limitation of liability 

All our products are covered by your statutory rights as a consumer. We do not guarantee that your use of the site will be uninterrupted or error-free. 

To the extent permitted by law, we will not be liable for indirect losses arising from your use of the site. Nothing in these Terms limits or excludes your statutory rights as a consumer under Irish and EU law, or our liability where the law does not allow it to be limited (for example, for defective products, gross negligence or fraud). 

Section 14 – Indemnification 

You agree to indemnify KINOA against third-party claims arising from your breach of these Terms or of the law, or from your infringement of the rights of any third party. 

Section 15 – Severability 

If any provision of these Terms is found to be unlawful, void or unenforceable, it will be enforced to the fullest extent permitted by law, and the unenforceable part will be deemed severed without affecting the validity of the remaining provisions. 

Section 16 – Termination 

Obligations incurred before termination will survive it. You may stop using our services at any time. If you breach these Terms, we may deny you access to the Service, without affecting orders already placed and paid for. 

Section 17 – Entire agreement 

Our failure to exercise or enforce any right under these Terms does not constitute a waiver of that right. These Terms and the policies published on this site constitute the entire agreement between you and us regarding your use of the Service. 

Section 18 – Governing law 

These Terms are governed by the laws of Ireland, and the Irish courts will have jurisdiction. If you are a consumer living in another EU country, this does not deprive you of the protection of the mandatory laws of your country of residence, and you may bring a claim before the courts where you live.
